Home Rental Terms and Conditions (Long-Term and Short-Term)
This document outlines the standard terms and conditions for home rentals managed by Travel Asia Holidays Sdn. Bhd. (hereinafter referred to as “the Agent”) for both long-term and short-term rentals in Malaysia.
1. Definitions
Tenant/Renter: The individual(s) or entity renting the property.
Owner/Landlord: The legal owner of the property.
Agent: Travel Asia Holidays Sdn. Bhd., acting as the intermediary between the Tenant and Owner.
Property: The residential unit or house being rented.
2. Rental Agreement
A formal rental agreement must be signed by both the Tenant and the Owner, facilitated by the Agent. The agreement will specify the rental duration, monthly rent, security deposit, and other terms.
3. Rental Duration
Short-Term Rental: Less than 6 months.
Long-Term Rental: 6 months or more.
4. Payment Terms
Security Deposit: Equivalent to 2 months’ rent (refundable upon termination of the lease, subject to property condition).
Utility Deposit: Equivalent to 1 month’s rent (refundable after settling all utility bills).
Advance Rent: 1 month’s rent paid in advance.
Payment Method: Bank transfer or cashier’s check payable to the Owner or Agent.
5. Tenant Responsibilities
Maintain the property in good condition.
Pay utility bills (electricity, water, internet, etc.) during the tenancy period.
Notify the Agent or Owner of any damages or repairs needed.
No subletting without prior written consent from the Owner.
6. Owner Responsibilities
Ensure the property is in habitable condition before the Tenant moves in.
Address maintenance and repair issues promptly (excluding damages caused by the Tenant).
Provide necessary documents (e.g., property ownership proof, utility account details).
7. Termination of Lease
Short-Term Rental: Either party may terminate the lease with 30 days’ written notice.
Long-Term Rental: Termination requires 60 days’ written notice. Early termination may incur penalties.
8. House Rules
No illegal activities or disturbances to neighbors.
Pets are allowed only with prior written consent from the Owner.
Smoking may be prohibited inside the property, depending on the Owner’s preference.
9. Agent’s Role
Facilitate the rental agreement between the Tenant and Owner.
Collect and disburse payments as agreed.
Act as a mediator in case of disputes.
10. Governing Law
This agreement is governed by the laws of Malaysia. Any disputes will be resolved through mediation or in the courts of Malaysia.
Documents to Prepare
For the Tenant:
Copy of NRIC (for Malaysians) or passport (for foreigners)
Proof of income (e.g., salary slips, bank statements)
Employment letter or student ID (if applicable)
Reference letter from previous landlord (if available)
For the Owner:
Copy of NRIC
Proof of property ownership (e.g., land title, strata title)
Latest utility bills (electricity, water, assessment)
Maintenance fee receipt (if applicable for stratified properties)
For the Agent (Travel Asia Holidays Sdn. Bhd.):
Letter of authorization from the Owner to manage the property
Copy of the rental agreement template
Inventory list (if the property is furnished)
Additional Notes
The Agent will conduct a property inspection before the Tenant moves in and after they vacate to document the property’s condition.
All parties are encouraged to communicate openly to ensure a smooth rental experience.
